A direção da SBPC e da Academia Brasileira de Ciência se manifestam contra eleição direta para reitor.
As duas entidades enviaram carta aos senadores solicitando uma audiencia pública sobre o projeto de lei que garante o processo de eleição direta para reitor. Na carta fica claro o posicionamento das duas entidades.

Senhores Senadores,
A Sociedade Brasileira para o Progresso da Ciência (SBPC) e a Academia Brasileira de Ciências (ABC) solicitam que a Comissão de Constituição, Justiça e Cidadania (CCJ), antes de votar o Substitutivo da Câmara dos Deputados (SCD) ao PLS 147/2004, realize uma audiência pública para debater tal proposição. O PLS 147/2004 altera o art. 56 da Lei no 9.394, de 20 de dezembro de 1996, estabelecendo o processo de eleições diretas para Reitor, Vice-Reitor e Diretores das instituições públicas de educação superior.
Na Câmara dos Deputados, o projeto tramitou como PL 4646/2004, e em 01/06/2011 foi aprovado um Substitutivo retornando ao Senado em 29/08/2011. No Senado Federal, o substitutivo SCD 147/2004 foi aprovado na Comissão de Educação, Cultura e Esportes (CE) e, no momento, está na Comissão de Constituição, Justiça e Cidadania (CCJ). Nessa Comissão, o senador José Pimentel foi designado relator e seu parecer é pela aprovação do Substitutivo.
Este projeto traz um tema polêmico e se baseia no mito de que instituir um processo de eleição direta nas universidades é promover um processo democrático. A democracia pode ser exercida por meio da consulta aos segmentos, dando voz a grupos, ouvindo minorias, sem que haja eleição direta. Numa eleição direta na Universidade, há o risco de se privilegiar as promessas corporativas e partidárias ao invés das acadêmicas e como resultado estabelecer uma divisão interna em ideologias político-partidárias.
A escolha dos dirigentes das universidades deve ser baseada na competência individual e no comprometimento com a qualidade das atividades científicas e do ensino superior. Nem sempre o processo de eleição direta garantirá a escolha acertada para que nossas universidades se qualifiquem junto às melhores do mundo contribuindo para o desenvolvimento cientifico e tecnológico do país. É importante lembrar que nenhuma universidade de classe mundial optou pelo processo de eleição direta para escolha de seus gestores. Na verdade a grande maioria escolhe seus reitores por comitê de busca.
A SBPC e a ABC entendem que esta matéria é de suma importância para a consolidação da ciência brasileira, e que ainda não foi discutida o suficiente para que seja apreciada pela Comissão de Constituição, Justiça e Cidadania (CCJ), última comissão a
analisar o projeto antes de voltar ao Plenário do Senado.
Assim, senhores senadores, reforçamos a necessidade de promover debate público antes da votação do SCD 147/2004 para que as diferentes posições e argumentos possam emergir e deste modo contribuir para a tomada de decisão mais adequada para a gestão de nossas universidades. Acreditamos que ao ser adiada a apreciação do projeto será muito oportuna a realização de audiência pública na CCJ.
